She is a Partner in the Firm’s Competition Law Practice with over 9 years’ experience in competition law matters. She advises clients on contentious and non-contentious competition law matters and is regularly sought out for abuse of dominance and cartel cases.
On the enforcement front, Nitika has been involved in defending companies in private as well as public sectors in cartel and abuse of dominance cases before the Competition Commission of India (CCI), the National Company Law Appellate Tribunal (NCLAT), and the Supreme Court of India. She has successfully defended WhatsApp LLC, Oil and Natural Gas Corporation and Asian Paints Limited against allegations of abuse of dominance. She also routinely advises clients in relation to their agreements and allegations of cartelisation. She was involved in obtaining an unconditional stay from the NCLAT on the CCI’s order against ACC Limited in a bid rigging case and has successfully represented Coal India Limited in a cartel complaint against its explosives suppliers. She represented Globecast Asia Pte Ltd in the first leniency application ever filed before the CCI, and was successful in obtaining a 100% reduction in penalty for Globecast and its officials.
In addition, Nitika is representing Monsanto Company (now Bayer), ACC Limited, WhatsApp and Meta Platforms, Inc. in proceedings pertaining to alleged anti-competitive agreements and abuse of dominance. She also advises and delivers trainings to companies to strengthen their compliance programmes.
On the merger control front, Nitika has represented clients across industry segments. She has been involved in the India leg of several complex global transactions including acquisition of Textile Effects division of Huntsman International LLC by Archroma Operations S.a.r.l.., Alstom by GE, Bombardier Transportation by Alstom, and the merger of Fiat with Peugeot, and Monsanto with Bayer.
Nitika has co-authored the India chapter in Lexology GTDT Cartel Regulation, 2023, Lexology GTDT Merger Control, 2023 and “Cartel Laws and Regulation” published in Global Legal Insights, 2019.
Nitika holds a B.A., LL.B. (Hons.) from the National Law University, Delhi. Prior to joining Shardul Amarchand Mangaldas, Nitika represented several companies before the Company Law Board and the Delhi High Court in high profile company law disputes.
