Kriti Kalyani is a Partner at the Firm and specialises in Litigation, Arbitration, and Insolvency & Bankruptcy. Kriti holds a B.A. L.L.B. (Hons.) degree from the National Law Institute University, Bhopal.
Kriti has advised domestic and foreign clients on matters involving legal and factual complexities related to contractual disputes, tender disputes, construction disputes, insolvency litigation, mergers and amalgamations and economic tort disputes. Kriti represents clients in a number of matters before the Supreme Court of India, Bombay High Court, District Courts in Mumbai, National Company Law Appellate Tribunal (NCLAT) and National Company Law Tribunals (NCLT).

General Corporate / Commercial Litigation
- Represented key managerial personnel (including the Chairman and Managing Director and CEO) of a publicly listed leading private sector bank in Defamation suit proceedings filed against them before the Bombay High court.
- Represented (i) a leading paints manufacturer and (ii) a leading media house in independent writ challenges to competition regulator’s orders before the Bombay High Court.
- Represented a U.S.-based company against an Indian counterparty in a commercial suit alleging breach of an exclusivity clause and related contractual claims before the Bombay High Court and Belapur district court;
- Represented a global private equity fund in a dispute with a leading healthcare services company where the counterparty sought enforcement of a non-binding term sheet before the Bombay High Court and Sole Arbitrator.
- Represented India’s largest public sector bank against prominent print media houses in a defamation suit before Bombay High Court for damages.
- Represented in tender disputes: (i) a leading payments and ATM services provider against a PSU bank in a procurement challenge before the Supreme Court of India and Bombay High Court; (ii) the successful awardee in a Union of India defense procurement tender before the Delhi High Court, successfully defending the award against a challenge by the unsuccessful bidder; and (iii) a leading pharmaceutical company in a procurement challenge before the Bombay High Court.

Arbitration
- Represented a state-owned metro project company against a leading EPC contractor in a domestic construction arbitration as well consequential proceedings under the Arbitration & Conciliation Act, 1996 (A&C Act) before the Supreme Court of India and Bombay High Court.
- Represented a trustee against a contributing entity of a SEBI – regulated alternate investment fund in an International institutional arbitration (SIAC).
- Represented a public sector credit insurance company in multiple arbitrations and appellate proceedings matters: (i) defending an arbitration brought by an exporter challenging rejection of its claim; and (ii) prosecuting an appeal under Section 37 of the A&C Act before the Bombay High Court against an order passed under Section 34 upholding an arbitral award directing payment of the remainder of a claim previously rejected by the insurer.
Company matters
- Advised and represented various listed and large corporates before the NCLT in schemes of arrangement (merger/demerger/capital reduction)
- Represented a leading global entertainment and media conglomerate in a dispute against a major Indian media company before NCLT Mumbai arising from termination of a merger agreement post sanction of the scheme by NCLT.
- Represented minority shareholders of a family-owned private limited company before the Supreme Court, NCLAT and NCLT in oppression and mismanagement claims.
Insolvency Litigation
- Advised and represented the Resolution Professional in Insolvency resolution for 2 large diversified telecom groups (multiple entities) across creditor disputes, disputes with the telecom regulator, and plan-related issues before the Supreme Court of India, Delhi High Court, NCLAT and NCLT, Mumbai.
- Represented a leading housing finance company before NCLAT and NCLT benches (Mumbai, Ahmedabad and Hyderabad) in different Section 7 Insolvency admission matters.
- Advised and represented the Resolution Professional in a first of its kind insolvency of a real estate project city spanning 10,000 acres near Pune in various homebuyer disputes, and plan related issues.
